1. Definitions

In this Agreement:

User, you, your means the person signing this Agreement (or, if a minor, the minor’s parent or legal guardian).

Facility, we, us, our means Boca Ice, its corporate affiliates, owners, agents, employees, officers, managers

Activities include all skating (public or private sessions, lessons, hockey, figure skating, event attendance, parties, etc.), use of the ice, equipment, rink premises, amenities and skating accessories.

 

2. Assumption of Risk

I understand that ice skating and other activities at the Facility involve inherent risks, hazards, and dangers, including but not limited to: slips, trips, falls; collisions with other skaters or fixed objects; falling from or with skates; injuries from skate blades, ice equipment, rink boards; changing ice conditions; equipment malfunction; possible exposure to communicable diseases, in appropriate behavior from other skaters, etc. By entering the Boca Ice facility and participating in any activities, I voluntarily assume all risks, whether known or unknown, inherent or arising from the negligence of the Facility or others.

 

3. Release of and Limitation of Liability

To the fullest extent permitted by law, I hereby release, waive, and discharge the Facility, its affiliated entities, owners, agents, employees, officers, volunteers, successors and assigns from any and all liability, claims, demands, causes of action, costs or expenses, including attorney’s fees, arising out of or relating to any loss, damage, injury or death that I may suffer, or property damage I may cause, whether caused by the negligence of the Facility or otherwise, arising from or related to my participation in Activities at the Facility. In any event, if liability is allocated by a court of competent jurisdiction, such liability shall be limited to the price paid by the customer for attending and participating in such activity.

 

Indemnification

I agree to indemnify, defend, and hold harmless the Facility and its agents, employees, officers and volunteers from any liability, loss, claim, demand or damages, including legal fees, arising out of or resulting from my conduct, negligence, or omission during my use of the Facility, or from breach of this Agreement.

 

4. Rules, Safety & Conduct

I agree that:

I will follow all posted rules, safety instructions provided by the Facility staff, and any verbal instructions.

I will wear appropriate safety gear (e.g. skates, padding, helmets) where required.

I will behave responsibly, avoid reckless conduct, and respect others’ safety.

I will inspect the premises and equipment before use and report any unsafe condition to the Facility.

In addition to the foregoing, I will follow all rules and regulations of the facility as attached hereto and as further set forth within the facility.

 

5. Medical Condition & Fitness

I warrant that I am physically able to participate in the Activities and have no medical condition that would make my participation more hazardous. If I have any physical or medical limitations, it is my responsibility to consult with a physician before participating. If I suffer injury while on-site, I grant permission for the Facility to obtain emergency medical treatment as needed, and I agree to be responsible for any medical costs.

 

6. Minor Participants

If the User is under the age of majority:

This Agreement must be signed by a parent or legal guardian.

The parent or guardian affirms that they have read and explained this Agreement, accept and assume all risks on behalf of the minor, and agree to all terms herein.

 

7. Media Release

I grant to the Facility the right to take photographs, video, or other images of me while I am on Facility premises or participating in Activities, and to use such images for promotional, advertising, or other lawful business purposes without compensation, unless prohibited by law or separate agreement.

 

8. Severability & Governing Law

If any part of this Agreement is held to be invalid or unenforceable, the remaining parts shall continue in full force and effect. This Agreement shall be governed by and construed under the laws of the state of Florida, without regard to its conflict of laws principles. Benue shall remain in Palm Beach County, Florida. In the event of a dispute arising out of or relating to this Agreement and the use of the skating facilities, the prevailing party shall be entitled to an award of its reasonable attorney fees and costs at all levels of legal proceedings, including appeals.

 

9. Acknowledgement & Understanding

I AFFIRM THAT I have read this Waiver, Release & User Agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.

Rules & Regulations

By signing this Agreement, you agree to abide by all of the following Rules & Regulations at all times while using the Facility. Violation of any rule may result in your removal from the Facility, suspension of skating privileges, or other legal action if warranted. Skating is an inherently dangerous sport and you are skating at your own risk.

A. General Rules

  1. Compliance with Staff: You must follow all posted signs, verbal directions, announcements, and instructions from Facility staff, skate guards, or security personnel immediately.
  2. Hours & Sessions: Skaters may only use the ice during posted open-skate sessions, scheduled lessons, or permitted private or special events. The Facility may interrupt, stop, or cancel sessions for ice maintenance (resurfacing), safety reasons, or at management’s discretion.
  3. Identification & Wristbands: If required, wear any Facility-issued identification (wristbands, badges) visibly and present them when requested.
  4. Supervision of Minors: Children under [insert age, e.g. 12] must be accompanied by an adult or approved guardian at all times. Minors must comply with rules and may be held responsible for actions of their guests.

B. On-Ice Conduct

  1. Footwear & Equipment:

Only properly fitting ice skates may be worn on the ice. No street shoes, boots, or non-skate footwear is permitted. All safety equipment required by Facility (helmets, guards, etc.) must be worn where posted or required, especially during sessions with hockey sticks, pucks, or for beginner/child skaters.

  1. Flow of Traffic & Right of Way:
    1. Always skate in the direction indicated by posted signs or by staff (often counterclockwise during public skate), unless otherwise directed.
    2. Give way to skaters performing routines, lessons, or with priority (e.g., program music, freestyle work).
    3. Stay aware of your surroundings; avoid stopping in high-traffic areas or blocking the path of other skaters.
  2. Safe Behavior:
    1. No horseplay, rough skating, racing, weaving through skaters, or intentional contact.
    2. No carrying other skaters, children, or objects while
    3. No jumping or performing spins except in designated areas or during appropriate sessions (if permitted).
    4. Do not sit, lie down, or obstruct the ice surface or the
  3. Ice Safety:
    1. Remain off the ice during ice resurfacing or when resurfacing equipment (e.g. Zamboni) is in operation.
    2. Report any hazardous conditions (ice damage, large snow buildup, cracks, loose boards, etc.) to Facility staff immediately.
    3. Do not damage the ice, boards, or any rink

 

C. Prohibited Activities

  1. Food, Drink & Smoking:
    1. No food, drink (other than water if permitted), chewing gum, or tobacco products on the ice.
    2. Smoking, vaping, and the use of illegal substances or being under the influence of alcohol or drugs are strictly prohibited anywhere in the Facility.
    3. If alcoholic beverages are consumed at the Premises, there is no use of the ice permitted after consumption of alcoholic beverages. All use of the ice or participating in Activities must be done before consuming alcoholic beverages.

 

Objects & Distractions:

  1. No carrying items such as bags, chairs, sleds, or other articles on the ice unless approved by Facility (e.g., skating aids).
  2. No use of cellphones, headphones, or other personal audio devices on the ice that may impair hearing or awareness (unless approved or required for program).
  1. Clothing & Appearance:
    1. Wear appropriate skating attire: gloves, fitted clothing, layers as needed; avoid items that may snag or entangle.
    2. No obscene or indecent clothing or offensive graphics

 

D. Facility Use & Respect

  1. Respect for Others:
    1. Treat all staff, other skaters, spectators with courtesy and
    2. No abusive, harassing, or discriminatory behavior or
    3. Disagreements or concerns should be raised with Facility management— do not engage in confrontations on the ice.
  2. Lost, Stolen or Damaged Property: The Facility is not responsible for lost or stolen items. Lockers or storage areas (if available) should be used. You are responsible for personal property and equipment.
  3. Cleanliness & Order:
    1. Dispose of trash in designated
    2. Use designated areas for changing, skating aids, benches; do not block exits or aisles.

E. Enforcement and Consequences

  1. Right to Refuse or Remove: The Facility reserves the right to refuse admission or remove any person who violates these Rules & Regulations or whose behavior is unsafe, disruptive, or otherwise inconsistent with this
  2. Warnings & Suspension: Depending on the severity of the violation, Facility management may issue warnings, suspend ice privileges temporarily or
  3. Reporting Injuries or Incidents: All accidents, injuries, or near misses must be reported immediately to Facility staff. An incident report may need to be
  4. Legal Rights Preserved: Enforcement of these rules does not limit the Facility’s rights to take further action (civil or criminal) in case of damage, injury, or violation of law.

    2. No obscene or indecent clothing or offensive graphics

 

D. Facility Use & Respect

  1. Respect for Others:
    1. Treat all staff, other skaters, spectators with courtesy and
    2. No abusive, harassing, or discriminatory behavior or
    3. Disagreements or concerns should be raised with Facility management— do not engage in confrontations on the ice.
  2. Lost, Stolen or Damaged Property: The Facility is not responsible for lost or stolen items. Lockers or storage areas (if available) should be used. You are responsible for personal property and equipment.
  3. Cleanliness & Order:
    1. Dispose of trash in designated
    2. Use designated areas for changing, skating aids, benches; do not block exits or aisles.

E. Enforcement and Consequences

  1. Right to Refuse or Remove: The Facility reserves the right to refuse admission or remove any person who violates these Rules & Regulations or whose behavior is unsafe, disruptive, or otherwise inconsistent with this
  2. Warnings & Suspension: Depending on the severity of the violation, Facility management may issue warnings, suspend ice privileges temporarily or
  3. Reporting Injuries or Incidents: All accidents, injuries, or near misses must be reported immediately to Facility staff. An incident report may need to be
  4. Legal Rights Preserved: Enforcement of these rules does not limit the Facility’s rights to take further action (civil or criminal) in case of damage, injury, or violation of law.
