Waiver of Liability and Assumption of Risk

Participant (Referred to as “I” or “me”) desires to participate in the soccer league and/or utilize the other amenities, including use of the pickleball courts, practice facility, and other related activities operated by The Soccer Center, an Arkansas limited liability company (the “Company”). As lawful consideration for being permitted and for the value that I will gain therefrom, I agree to the terms and conditions set forth in this Release and Waiver of Liability and Assumption of Risk (this “Agreement”).

1. I RELEASE, WAIVE, DISCHARGE and PROMISE NOT TO SUE the Company, its affiliates, trainers (employees or contractors), and/or the owners of the premises in which the activities take place, including their heirs and assigns (collectively, “Releasees”), from any and all liability, claims, demands, actions and causes of action (whether known or unknown) arising in any way out of or related to any loss, damage, or injury, including permanent disability or death, that may be sustained by me or my property, caused by the negligence of the Releasees or otherwise, while participating in such activity, or while in, on, or upon the premises where the activity is being conducted, to the fullest extent provided by law.

2. I am fully aware and understand the risks and hazards connected with the soccer league, use of the pickleball courts, practice facility, and other related activities, including but not limited to contact and collision with persons or objects, contact with other participants, encounter with obstacles, weather-related hazards, judgment- and/or behavior-related problems, inadequate or negligent first aid and/or emergency measures, and I elect to voluntarily participate in the activity, and to engage in such activities knowing that the activity may be hazardous to me and/or my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY for any risks of loss, property damage or personal injury, including permanent disability or death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in the activity whether caused by the negligence of Releasee or otherwise.

3. I further agree to indemnify and hold harmless the Company and all other Releasees from any loss, liability, damage or costs, including court costs and attorney fees that they may incur due to my participation in the soccer league, use of the pickleball courts, practice facility, and other related activities, including but not limited to contact and collision with persons or objects, contact with other participants, encounter with obstacles, weather-related hazards, judgment- and/or behavior-related problems, and inadequate or negligent first aid and/or emergency measures, whether caused by the negligence of Releasees or otherwise.

4. It is my express intent that this Agreement shall bind the members of my family and spouse if I am alive, and my heirs, assigns, and personal representative if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, and COVENANT NOT TO SUE the above named Releasees. If any provision of this Agreement is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. I further agree that this Agreement shall be construed in accordance with the laws of the State of Arkansas.

IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I HAVE READ THE ABOVE AGREEMENT, FULLY UNDERSTAND IT, AND SIGN IT VOLUNTARILY AS MY OWN FREE ACT AND DEED. NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENTS APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE. I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND FULLY COMPETENT, AND I EXECUTE THIS AGREEMENT IN EXCHANGE FOR BEING ALLOWED TO PARTICIPATE IN THE ACTIVITY FULLY INTENDING TO BE BOUND BY SAME.
